COVID-19 has increased financial anxiety in just about every industry. As corporations look to their insurance for coverage, insurers are pushing back. Coverage litigation is exploding with hundreds of filings to date, and many more on the way. Legislatures have explored intervention while insurance regulators have sought information on what is covered by the insurers. The COVID-19 Insurance Litigation Virtual Summit will review the latest developments and emerging areas of dispute, to provide corporations with a comprehensive understanding of where we are and where this is all going.

As of writing, over two hundred cases have been filed by policyholders and insurers. These cases touch on a broad range of issues but are primarily focused on business interruption claims. Some of them seek expedited or specialized relief in the form of class actions, MDL proceedings, and/or injunctive relief. Motions to dismiss are being briefed in some of the actions and it appears likely that the first ruling will be on a preliminary injunction application in the Southern District of New York. This panel will address:

  • Where things are going with litigation in the near future
